Houston's Unique Situation: No Traditional Zoning
Houston is the only major U.S. city without a traditional comprehensive zoning code. However, this does not mean sign rules don't exist β it means they work differently.
In Houston, sign regulations come from two sources:
- City Sign Code Ordinance β Houston's citywide sign ordinance establishes rules for sign types, sizes, illumination, and placement. This applies everywhere in the city regardless of deed restrictions.
- Deed restrictions β Private property covenants (deed restrictions) function similarly to zoning in most Houston neighborhoods. Deed restrictions may limit or prohibit signs that the city's ordinance would otherwise allow. Many commercial areas have deed restrictions that specify sign types, colors, and sizes.
You must comply with both the city's sign ordinance and any applicable deed restrictions. To check whether your property has deed restrictions: search the Harris County Appraisal District (HCAD) database and review the recorded deed at the Harris County Clerk's office.
What Requires a Sign Permit in Houston
- All permanent wall signs (illuminated and non-illuminated over 9 sq ft)
- All freestanding signs (monument, pole)
- All illuminated signs
- Electronic message center / digital signs
- Any sign over 9 sq ft in area
- Temporary signs displayed longer than 30 days
Generally exempt in Houston: Non-illuminated wall signs under 9 sq ft; window signs; address identification; interior signs.
